Social worker who alerted police claims to be aware of illegal organ sale but was waiting for concrete proof
The Powai Police claim to have busted a kidney trading racket at Dr LH Hiranandani Hospital with the arrest of four persons, including an agent, a patient and his son, and an alleged donor who impersonated as the patient’s wife and alleged to be the mastermind, on July 14.
On the complaint of one social worker Mahesh Tanna, we have registered the offence under Sections 419 (punishment for cheating by personation), 420 (cheating), 465 (punishment for forgery), 467 (forgery of valuable security), 468 (forgery for purpose of cheating), 471 (using as genuine a forged) and 120(b) (punishment of criminal conspiracy) of Indian Penal Code r/w 19 Transplantation of Human Organs Act 1994,” said Powai Police Station Sub-Inspector RD Mote.
THE CASE
According to the Powai Police, Brijkishore Jaiswal (48), who was admitted in Hiranandani Hospital for kidney failure, was approached by one ‘agent’ Vijendra Visan and assured of an organ donor on payment of around Rs 30 lakh. “Visan knew that only a family member can donate the organ or donor bank can arrange so he planted a woman posing as the wife of patient (Jaiswal). The hospital documents show the woman named as Rekha (fake name). The agent allegedly fabricated her marriage certificate and promised her of money. She was told that the procedure would be of one month so she needs to remain present in the hospital. On July 14, just before two hours of operation, the police came to know about the alleged kidney transplantation following a complaint from social worker Tanna,” a police official said.
THE COMPLAINANT
Tanna said, “We reached the hospital along with Assistant Police Inspector (Powai Division) Samad Shaikh before the illegal kidney transplantation operation could take place. The hospital authorities were shown fabricated documents of Rekha (imposter). Most of the information were missing on the marriage record documents submitted to the hospital. After thorough examination by the hospital authority and scrutinising documents, the police found Visan’s involvement.” Tanna said that Visan was in possession of other related documents admitted to have been fabricated by him. “I was aware that the racket was going on in hospital but was waiting for concrete proof,” he said.
The police arrested Jaiswal, his son Kisan along with the imposter woman Rekha and agent Visan, and they will be produced in the magistrate court on July 15. “We are questioning the Hiranandani Hospital staff and authorities. The accused is also probed to find out the amount decided by the donor and the role of doctors, hospital authorities,” Mote said.
Meanwhile, Dr LH Hiranandani Hospital issued a statement on July 14: A husband and wife were slated to undergo a kidney transplant surgery at our hospital today. The hospital got to know that it may be a case of false identification and the couple is not related. The hospital administration immediately swung into action and cancelled the surgery. No organ was retrieved from the donor. We cooperated with the police and shared all the legal documents submitted by the couple to the Institutional Ethic Committee as part of the approval process (as mandated by law). The police are investigating the matter and the hospital is fully supporting the police investigate the matter thoroughly. We are bringing this matter to the attention of other healthcare service providers and health authorities as well so that such fraudulent behaviour is checked and sincere donors and recipients do not suffer because of the wrongdoings of some. The hospital, continuing the legacy of its illustrious founder, adheres to high standard of ethics and works for the betterment of society.
